Frequently Asked Questions: Taxation Advisory

Transfer pricing rules require transactions between your Indian company and its foreign group entities, such as purchases, services, royalties or loans, to be priced at arm's length. If your subsidiary has such transactions, it must keep TP documentation and file Form 3CEB every year.

Form 3CEB is due one month before the income tax return due date, which for most companies with international transactions means 31 October.

Under Section 197 you can apply to the tax department for a certificate that lets payers deduct tax at a lower or nil rate. It helps when normal TDS would be higher than your actual tax liability.

To claim a lower rate under a Double Taxation Avoidance Agreement, a non-resident must give the Indian payer a Tax Residency Certificate and file Form 10F electronically on the income tax portal.

Yes. We review the notice, prepare the reply and supporting documents, and represent you before the tax authorities during assessments and appeals.
